In general, ERISA's provisions apply to any employee benefit plan maintained by an employer engaged in any industry or activity affecting commerce, an employee organization representing employees engaged in any industry or activity affecting commerce, or both. The term "employee benefit plan" encompasses both employee pension benefit plans and welfare plans.
