Is an employer required to offer retirement plan coverage to its employees?

No. An employer is not required to offer retirement plan coverage. The employer generally decides whether to offer a retirement plan to its employees and, if it does, has the ability to set many plan terms, including the level of benefits. In the case of employees covered by a collective bargaining agreement, retirement benefits are subject to the bargaining process. Thus, the retirement plans and benefits available to employees vary from employer to employer.
