Are punitive damages available?

ERISA does not specify whether punitive damages are available; however, the Supreme Court has held that any recovery against a fiduciary for breach of duty is to be made only in favor of the plan and that plan fiduciaries have no personal liability to participants and beneficiaries for punitive damages under ERISA.
