Benjamin Moore & Co. v. The Travelers Insurance Company, United States District Court, Northern District of Illinois, Case No. 04C-3229.

At termination, Travelers exercised surrender and termination charges of about 5% of contract balances, which included mutual funds sponsored by related entities. Pursuing ERISA action to recover surrender charges and penalties retained by Travelers, as well as profits made by Travelers and related entities on mutual fund investments. United States District Court, Northern District of Illinois, Case No. 04-3299.
